Правовою підставою для здійснення закупівлі шляхом проведення переговорної процедури є підпункт 10 пункту 13 Особливостей. Зазначена норма передбачає, що переговорна процедура закупівлі, відповідно до якої замовник укладає договір про закупівлю після проведення переговорів щодо ціни та інших умов договору про закупівлю з одним або кількома учасниками процедури закупівлі, застосовується замовником як виняток у разі коли замовник або його відокремлений підрозділ, що здійснює закупівлю згідно з абзацом другим пункту 15 цих особливостей, перебуває на території активних бойових дій, які не були завершені на дату укладення договору про закупівлю. Комунальне підприємство «Ритуальна служба» Нікопольської міської ради знаходиться на території міста Нікополь (Нікопольська міська територіальна громада), яка станом на 29.10.2026 року зазначена в Переліку як територія активних бойових дій, на яких функціонують державні електронні інформаційні ресурси, які не були завершені, код територіальної громади UA12080050010010114.
