Відповідно до ч.7 ст. 137 ЗКУ, п.29 Вимог щодо підготовки до проведення та проведення земельних торгів для продажу земельних ділянок та набуття прав користування ними (оренди, суперфіцію, емфітевзису) затверджених Постановою КМУ №1013 від 22.09.2021р. із змінами від 01.03.2024р., 03.09.2025 р., 10.12.2025р.

Additional info:

Умови користування земельною ділянкою вказано у п.5 Рішення Городоцької міської ради №26/77-9706 від 25.06.2026р. (див. додатки). Встановити такі умови користування земельною ділянкою: Використовувати земельну ділянку виключно за цільовим призначенням та відповідно до умов договору оренди землі з дотриманням вимог земельного, містобудівного та іншого чинного законодавства України. Переможець земельних торгів у формі електронного аукціону, крім сплати орендної плати та інших обов’язкових платежів, передбачених законодавством та договором оренди землі, зобов’язується безоплатно передати у комунальну власність Городоцької міської ради квартири загальною площею не менше 8 % від загальної житлової площі квартир, збудованих у житловому будинку або відповідній черзі будівництва для забезпечення житлом ветеранів російсько-української війни. Передача квартир у комунальну власність Городоцької міської ради здійснюється протягом 60 (шістдесяти) календарних днів з дня введення в експлуатацію житлового будинку або введення в експлуатацію відповідної черги будівництва. Погодження квартир Перелік квартир, їх площа, поверховість, технічні характеристики та місце розташування погоджуються з Городоцькою міською радою Львівської області. При цьому загальна площа квартир не може бути меншою ніж 8 % від загальної житлової площі об’єкта будівництва. Квартири, що передаються у комунальну власність, повинні: бути завершеними будівництвом; відповідати державним будівельним нормам; бути придатними для проживання; бути забезпеченими інженерними мережами та комунікаціями; передаватися без обтяжень, арештів, іпотеки та будь-яких прав третіх осіб. Передача квартир оформляється актом приймання-передачі з подальшою державною реєстрацією права комунальної власності за Городоцькою міською радою. Витрати, пов’язані з оформленням права власності, виготовленням технічної документації та державною реєстрацією права комунальної власності на квартири, покладаються на переможця земельних торгів. З метою додаткового захисту інтересів територіальної громади та забезпечення гарантій отримання житла допускається передача Городоцькій міській раді Львівської області майнових прав на майбутні об’єкти нерухомого майна. Такі права можуть бути передані протягом 60 календарних днів з дня отримання забудовником декларації або дозволу на початок виконання будівельних робіт. Передача майнових прав здійснюється шляхом: укладення договору про передачу майнових прав; визначення конкретних квартир; державної реєстрації відповідних обтяжень або прав у встановленому законом порядку. Умови щодо передачі квартир чи прав на майбутні об’єкти нерухомості у комунальну власність є істотними умовами договору оренди землі та обов’язковими для виконання переможцем земельних торгів.
