Конкретне цільове призначення/додаткові умови оренди, що визначені органом місцевого самоврядування на основі окремого рішення Рівненської міської ради від 02 квітня 2026 року № 8133 «Про включення нежитлових приміщень у будинку № 57 на вул. Соборній до Переліку першого типу для передачі в оренду на аукціоні комунального майна з метою розміщення книгарні та визначення додаткових умов оренди»: приміщення використовується виключно як спеціалізований магазин для торгівлі книгами і лише для видів економічної діяльності та на площах не більших ніж ті, що вказані в цьому підпункті, а саме: – роздрібна торгівля книгами в спеціалізованих магазинах (код виду економічної діяльності, який дозволено, відповідно до Класифікації видів економічної діяльності – 47.61), у тому числі продаж підручників та освітньої літератури на площі, яка не менша ніж 80 % від загальної площі приміщення, (що становить 138,5 м2 ), займає торговельний зал (зали), облаштований торговельним обладнанням, включаючи книжкові полиці, площу для … обслуговування споживачів, робочі місця продавців, вузли розрахунку. – до 20 % від загальної площі приміщення, що становить 34,6 м2 , може використовуватися для здійснення на цій частині площ таких видів економічної діяльності, які дозволено: обслуговування напоями; діяльність ресторанів, надання послуг мобільного харчування; роздрібна торгівля кондитерськими виробами; роздрібна торгівля газетами та канцелярськими товарами в спеціалізованих магазинах (відповідні коди Класифікації видів економічної діяльності: 56.30, 56.10, 47.24, 47.62), і за умови, що діяльність на цій меншій площі не змінює головне призначення приміщення – спеціалізований магазин для торгівлі книгами

Additional conditions for the lease of the property:

1. Цільове призначення (конкретне цільове призначення та додаткові умови оренди, що визначені органом місцевого самоврядування на основі окремого рішення Рівненської міської ради від 02.04.2026 № 8133. 2. У книгарні забезпечується реалізація книжкової продукції державною мовою і частка видань державною мовою становить не менше 60 % від загального асортименту книжкової продукції (за назвами) за підсумками кожного кварталу дії договору оренди. 3. Забороняється використовувати приміщення, в тому числі частково: - для розміщення торговельних об’єктів з продажу непродовольчих товарів народного споживання (крім використання до 20 % площ з метою, яка вказана в пункті 21 оголошення), технічно складних побутових товарів, ювелірних виробів, лікарських засобів; - для продажу товарів підакцизної групи (алкогольні напої, тютюнові вироби та інші підакцизні товари); - для будь-якої іншої діяльності, що не зазначена у пункті 21 оголошення. 4. Орендар не має права використовувати майно за будь-яким цільовим призначенням, а … зобов’язаний використовувати його виключно за цільовим призначенням, визначеним у пункті 21 оголошення. 5. Внесення змін до договору в частині умов і додаткових умов оренди, крім визначених у рішенні Рівненської міської ради від 02.04.2026 № 8133 та в чинному законодавстві, не допускається; 6. Зменшення орендної плати протягом строку дії договору не допускається, крім випадків, прямо передбачених у законі; 7. Передача приміщення (частини) в суборенду та/або в якості внеску за договором про спільну діяльність / управління майном / франчайзинг тощо можлива лише для видів діяльності, визначених цільовим призначенням, визначених у пункті 21 оголошення. 8. Договір підлягає достроковому розірванню в односторонньому порядку в разі будь-якого порушення орендарем; 9. Орендар зобов’язується щорічно до 01 березня року наступного за роком дії договору оренди подавати постійній комісії Рівненської міської ради з питань бюджету, фінансів та управління комунальною власністю звіт про дотримання умов щодо цільового призначення за формою, що буде вказана балансоутримувачем. Звіт має містити підтвердження частки україномовної продукції в загальному асортименті і схему використання площі приміщення. Кількість кроків аукціону за методом покрокового зниження стартової орендної плати та подальшого подання цінових пропозицій – 10.
