Орендар одержує право на викуп орендованого майна за ціною, визначеною за результатами його незалежної оцінки, якщо виконується кожна з таких умов: орендарем здійснено поліпшення орендованого майна, які неможливо відокремити від відповідного об’єкта без заподіяння йому шкоди, в розмірі не менш як 25 відсотків ринкової вартості майна, визначеної суб’єктом оціночної діяльності для цілей оренди майна; орендар отримав письмову згоду орендодавця на здійснення невід’ємних поліпшень, які надають йому право на приватизацію майна шляхом викупу; невід’ємні поліпшення виконані в межах трирічного строку з дати визначення ринкової вартості майна для цілей укладання договору оренди або для цілей продовження договору оренди; здійснення і склад невід’ємних поліпшень, у тому числі невід’ємний характер поліпшень, підтверджені висновком будівельної експертизи, а вартість невід’ємних поліпшень, підтверджених висновком будівельної експертизи, визначена суб’єктом оціночної діяльності; орендар належно виконує умови договору … оренди, відсутня заборгованість з орендної плати; договір оренди є чинним на момент приватизації. 2. Передача в суборенду зазначеного нерухомого майна комунальної власності Тульчинської міської ради – дозволяється; 3. Орендар зобовязаний: - виконанувати певні види ремонтних робіт (капітального ремонту), реконструкції об’єкта оренди за погодженням рішенням сесії Тульчинської міської ради; - утримувати в належному технічному стані конструктивні елементи Об’єкта оренди; - дотримуватися санітарно-екологічних норм встановлених законодавством України; - дотримуватися протипожежних заходів встановлених законодавством України; - забезпечити дотримання заходів цивільної безпеки встановлених законодавством України; - дотримуватися належних умов утримання та вимог щодо експлуатації майна; - дотримуватися державно-будівельних норм ; - брати участь в обслуговуванні прилеглої території пропорційно займаній площі; - вживати заходи для захисту навколишнього природного середовища з метою дотримання екологічних норм експлуатації Об’єкта; - створення безпечних умов праці; 4. Підключення об’єкта оренди до мереж електропостачання, теплопостачання, водопостачання здійснюється за рахунок орендаря.
