Якщо в складі тендерної пропозиції надається документ, що складений на іншій мові, учасник надає переклад цього документу українською мовою, завірений підписом уповноваженої особи учасника. Тендерні пропозиції підготовлені Учасниками - нерезидентами України можуть бути викладені іншою мовою, при цьому повинні мати переклад українською мовою, вірність перекладу (або справжність підпису перекладача) повинна бути засвідчена нотаріально або документ повинен бути легалізований у встановленому законодавством України порядку. У разі розбіжностей з текстом оригіналу перевага надається україномовному тексту. Власні назви, торгові марки, марки, моделі, назва виробника, дилера, дистрибютора, найменування адміністративних одиниць, адреси, абревіатури, значення технічних характеристик, топоніми, фірмові бланки, адреси сайтів, посилання, які викладені іншою мовою ніж українська, в документах, що входять до складу тендерної пропозиції, не потребують перекладу українською мовою; Умови надання забезпечення тендерних пропозицій: Гарантія має містити: найменування, номер, дату, місце складання; реквізити гаранта – повну та/або скорочену назву, його юридичну і фактичну адресу, ідентифікаційний код за ЄДРПОУ; реквізити принципала – повну та/або скорочену назву принципала, що збігається з назвою, яка зазначена ним у картці із зразками підписів і відбитка печатки (для фізичної особи – прізвище, ім’я та по батькові та документ, що її засвідчує (серія, номер, дата, ким виданий, місце проживання), його місцезнаходження, ідентифікаційний код за ЄДРПОУ; реквізити бенефіціара – назву, ідентифікаційний код за ЄДРПОУ, місцезнаходження, банківські реквізити; реквізити оголошення про закупівлю – назва предмету закупівлі, номер оголошення про проведення закупівлі, посилання на тендер на офіційному сайті http://prozorro.gov.ua; дату, номер і назву (у разі наявності таких реквізитів) відповідного документа, з якого виникають базові відносини; суму гарантії цифрами та словами і валюту платежу; дату закінчення дії гарантії; умови, за яких надається право вимагати платіж, відповідно до пункту 3.2 Розділу 3 тендерної документації; умови щодо зменшення/збільшення суми гарантії – "сума гарантії залишається незмінною"; умови, за яких можна вносити зміни до тексту гарантії принципалом, бенефіціаром, банком-гарантом. Електронна банківська гарантія повинна бути засвідчена електронним цифровим підписом або кваліфікованим електронним підписом уповноваженої особи Гаранта. Гарантія повинна бути видана банком-гарантом на умовах грошового забезпечення (покриття) з метою забезпечення виконання зобов'язання за гарантією в повному обсязі у разі настання випадків, передбачених частиною 3 статті 25 Закону. Грошове забезпечення (покриття) гарантії повинно бути підтверджено шляхом надання у складі пропозиції оригіналу довідки (листа, тощо), виданої банком-гарантом, завіреної печаткою банку-гаранту та підписом уповноваженої особи банку-гаранту, яка повинна містити реквізити гарантії, забезпеченої грошовим покриттям, дату видачі такої довідки, найменування принципала, його ідентифікаційний код, а також свідчити про забезпечення гарантії відповідним покриттям в розмірі, що дорівнює сумі банківської гарантії. Строк дії забезпечення тендерної пропозиції повинен бути не меншим строку дії тендерної пропозиції, а саме не менше 90 днів з дати кінцевого строку подання тендерних пропозицій

The electronic bank guarantee must be certified by an electronic digital signature or a qualified electronic signature of the Guarantor's authorized person. The guarantee must be issued by the guarantor bank on the terms of cash security (coverage) in order to ensure the fulfillment of the obligation under the guarantee in full in the event of cases provided for in part 3 of Article 25 of the Law. Monetary security (coverage) of the guarantee must be confirmed by providing as part of the proposal the original certificate (letter, etc.) issued by the guarantor bank, certified by the seal of the guarantor bank and the signature of the authorized person of the guarantor bank, which must contain details of the guarantee secured by cash, the date of issuance of such a certificate, the name of the principal, his identification code, as well as to certify the provision of the guarantee with appropriate coverage in the amount equal to the amount of the bank guarantee. The term of the tender offer security shall be not less than the term of the tender offer validity, namely not less than 90 days from the date of the deadline for submission of tender offers.
