Закупівля здійснюється на підставі наявної потреби, згідно вимог Постанови Кабінету Міністрів України від 12 жовтня 2022 р. № 1178 «Про затвердження особливостей здійснення публічних закупівель товарів, робіт і послуг для замовників, передбачених Законом … України “Про публічні закупівлі”, на період дії правового режиму воєнного стану в Україні та протягом 90 днів з дня його припинення або скасування» відповідно до “Порядку формування та використання електронного каталогу”, затвердженого постановою Кабінету Міністрів України від 14 вересня 2020 р. № 822. Технічні, якісні та кількісні характеристики товару - згідно умов Договору та Специфікації. Строк поставки (передачі) товарів: з моменту підписання Договору до 31 грудня 2025 року. Постачальник здійснює поставку Товару Замовнику партіями, в міру необхідності, за його Заявкою. Постачальник здійснює поставку Товару до складу Замовника (місця поставки) протягом ДВОХ календарних днів з дня отримання Заявки від Замовника, не рахуючи дня надіслання йому Замовником Заявки.

Згідно з допущеною технічною помилкою, а саме публікацією Замовником некоректного проєкту договору, є необхідність у скасуванні даної закупівлі. Відповідно, у замовника відсутня подальша потреба у закупівлі товарів, робіт чи послуг. У пункті 65 Порядку № 822 вказано, що Замовник може відмінити запит пропозицій постачальників до укладення договору у разі відсутності подальшої потреби в закупівлі. Таким чином, оскільки договір з переможцем відбору ще не укладено, є необхідність у прийнятті рішення щодо відміни запиту пропозицій по предмету закупівлі. Враховуючи викладене, закупівля підлягає скасуванню.
