Підпунктом 3 пункту 65 Порядку №822 встановлено, що замовник може відмінити запит ціни пропозицій до укладення договору про закупівлю якщо здійснення закупівлі стало неможливим внаслідок дії обставин непереборної сили, а саме, в технічній специфікації не зазначено можливі допустимі (від/до) значення (відповідно до ДСТУ) необхідного товару. Тобто, для Замовника настали дії обставин непереборної сили які не дають можливості здійснити закупівлю товару необхідної якості. Враховуючи викладене, запит пропозицій постачальників щодо Закупівлі підлягає відміні.
