Оголошення про проведення спрощеної закупівлі розроблене на виконання вимог абз. 3 п. 1 ч. 1 Постанови КМУ від 28 лютого 2022 р. № 169 «Деякі питання здійснення оборонних та публічних закупівель товарів, робіт і послуг в умовах воєнного стану» (із змінами) та ст. 14 Закону України «Про публічні закупівлі» № 922-VIII від 25.12.2015 р. (із змінами).

Explanation

Замовником 20 жовтня 2022 року було оголошено спрощену закупівлю на придбання товару «Розкидач дорожніх сумішей РДС-3». Проте, з 19.10.2022 набрала чинності Постанова КМУ № 1178, відповідно до якої віднині мають проводитись усі закупівлі. Замовник не промоніторив дату обрання чинності Постанови № 1178, тому не включив нові вимоги до оголошення про закупівлю. Дане порушення виправити немає змоги.
