Explanation

Під час проведення публікації оголошення про закупівлю було оприлюднено проєкт договору про закупівлю із зазначенням назви виробника та моделі товару з коротким описом його технічних характеристик. Відповідно до абзацу 3 пункту 66 Порядку №822 умови договору не можуть відрізнятися від умов, визначених замовником у запиті пропозицій постачальників, зокрема у проекті договору, що є складовою частиною запиту пропозицій постачальників, та/або пропозиції переможця відбору, крім випадку зменшення ціни договору без зміни обсягу. Оскільки, товар, що запропонований учасниками закупівлі не відповідає зазначеній у примітках до закупівлі та у проекті договору назві виробника та моделі, а за своїми технічними характеристиками та якістю освітлення може суттєво відрізнятись від них, прийнято рішення скасувати закупівлю на підставі підпункту 1 пункту 65 Порядку №822, у зв'язку з неможливістю зміни умов оприлюднених у проєкті договору.
