Порядок здійснення закупівель в електронному каталозі Prozorro Market встановлений Постановою №822 від 14.09.2020 року. Згідно пп. 3 п. 66 Постанови умови договору не можуть відрізнятися від умов, визначених замовником у запиті пропозицій постачальників, зокрема у проекті договору, крім випадку зменшення ціни договору без зміни обсягу. Оскільки умови зазначені в проекті договору, зокрема щодо врахування ціни ПДВ за товар, відрізняються від умов визначених замовником у запиті пропозицій постачальників (без ПДВ), то немає можливості підписати договір на умовах визначених в проекті договору.
