Закупівля здійснюється згідно постанови Кабінету Міністрів України від 11.11.2022 № 1275 «Деякі питання здійснення оборонних закупівель на період дії правового режиму воєнного стану» зі змінами. Обов’язкова наявність АЗС на території Вінницької області. … Талони повинні мати термін дії не менше одного року з моменту їх отримання та повинні діяти на всіх АЗС Учасника. Учасник, відповідно до письмової заявки Замовника, у разі необхідності (обмін талонів старого зразку на талони нового зразку, закінчення терміну дії, пошкодження тощо, забезпечує протягом семи робочих днів безкоштовний обмін талонів рівнозначного номіналу без врахування коливання ціни, протягом дії Договору так і впродовж не менше одного року з дня постачання талонів. Замовник керується нормами чинного законодавства України, а саме умовами Постанови Кабінету Міністрів України від 02 березня 2022 р. № 178 «Деякі питання обкладення податком на додану вартість за нульовою ставкою у період воєнного стану» встановлено, що до припинення чи скасування воєнного стану операції з постачання бензину А-95 в талонах обкладаються податком на додану вартість за нульовою ставкою. Бензин А-95 (Євро 5), талон. Місце поставки: АЗС Учасника у м. Могилеві-Подільському. Паливо переходить у власність Замовника окремими партіями за замовленням. Кількість і вартість кожної партії визначається у видатковій накладній. Замовлення оформлюється … у письмовій формі і повинно містити відомості про кількість та асортимент кожної окремої партії Товару, дату замовлення, підпис особи, уповноваженої направляти замовлення від імені Замовника. Замовлення може здійснюватись факсимільним зв’язком або електронною поштою. Паливо, що перейшло у власність Замовника, зберігається на АЗС Учасника до моменту передачі Палива Учасником по Талонах Замовнику. Строк поставки партії Товару - 3 (три) робочі дні з дати отримання замовлення Учасником. Умови оплати: розрахунки за замовлений та відповідно поставлений Товар здійснюються шляхом безготівкового перерахування коштів на поточний рахунок Учасника впродовж 10 (десяти) банківських днів після підписання Сторонами видаткової накладної та надання Учасником Замовнику рахунку-фактури на оплату Товару.
