Гарантія: не менше 12 місяців. Істотні умови Договору про закупівлю не можуть змінюватися після його підписання до виконання зобов'язань сторонами у повному обсязі, крім випадків передбачених п.19 Постанови КМУ «Про затвердження особливостей здійснення публічних закупівель товарів, робіт і послуг для замовників, передбачених Законом України «Про публічні закупівлі», на період дії правового режиму воєнного стану в Україні та протягом 90 днів з дня його припинення або скасування» від 12.10.2022р. №1178 (зі змінами).

Explanation

Відхилення пропозиції Учасника ФОП Григор’єв Михайло Олександрович по предмету закупівлі: Кондиціонери за кодом CPV за ДК 021:2015 39710000-2 - Електричні побутові прилади. Ідентифікатор закупівлі : UA-2023-05-22-008522-a Уповноваженою особою було розглянуто необхідність відхилення пропозиції по вищезазначеному запиту ціни з наступних причин: Учасником ФОП Григор’єв Михайло Олександрович було надіслано лист –повідомлення про не можливість підписання договору в зв’язку з неочікувани і різким підняттям цін на представництві . З огляду на вищевикладене та керуючись Постановою № 822 від 14 вересня 2020 року(зі змінами) «Про затвердження Порядку формування та використання електронного каталогу» (далі- Порядок) згідно п.66 абз.1 в якій зазначено, Замовник укладає договір про закупівлю з переможцем відбору не пізніше ніж через 10 календарних днів з дня отримання від переможця відбору повідомлення щодо наміру укласти договір про закупівлю. А також враховуючи п.49 абц.1 Порядку у разі порушення постачальником строків оформлення замовлення та/або відмови постачальника від підписання договору про закупівлю на умовах, що зазначені в його пропозиції, замовник може подати звернення з інформацією про такі порушення через електронну систему закупівель до адміністратора та п.65 Замовник може відмінити замовлення/запит ціни пропозицій до укладення договору про закупівлю. ВИРІШЕНО: 1. Відхилити пропозицію Учасника ФОП Григор’єв Михайло Олександрович по предмету закупівлі: Кондиціонери за кодом CPV за ДК 021:2015 39710000-2 - Електричні побутові прилади з підстав порушення Учасником п.66 абз.1 Порядку та п.49 абц.1. 2. Враховуючи відсутність технічної можливості відмінити закупівлю (замовлення) керуючись п.65 Постанови КМУ від 14.09.2020 р. №822 «Про затвердження Порядку формування та використання електронного каталогу» (далі-Порядок), Замовник відміняє замовлення в зв’язку з неможливістю усунення порушень, що виникли через виявлені порушення законодавства з питань публічних закупівель. 3. Уповноваженій особі в установленому законодавством порядку та в строки відповідно до абз.2 п.65 Порядку оприлюднити в електронній системі закупівель повідомлення про відміну вищезазначеного замовлення.
