Обґрунтування та умови застосування закупівлі без використання електронної системи в одного учасника: Акціонерне товариство «Херсонобленерго» (далі АТ «Херсонобленерго») входить до переліку суб’єктів природних монополій, який розміщується на веб-сайті … Антимонопольного комітету України та забезпечує розподіл електричної енергії. Враховуючи вищенаведене, виникла необхідність в закупівлі без використання електронної системи послугу з розподілу електричної енергії у АТ «Херсонобленерго»), згідно із вимогами ст.3 ч.7 п.2 Закону України «Про публічні закупівлі», а саме – відсутність конкуренції з технічних причин на відповідному ринку, внаслідок чого договір про закупівлю може бути укладено лише з одним постачальником, за відсутності при цьому альтернативи.
