Відповідно до постанови НКРЕКП від 16.11.2018 № 1447. Закупівля послуг з розподілу електричної енергії проводитися відповідно до абзацу 4 пункту 2 частини 7 статті 3 Закону України «Про публічні закупівлі» (без застосування порядку проведення спрощеної … закупівлі), а саме, відсутність конкуренції (у тому числі з технічних причин) на відповідному ринку, внаслідок чого договір про закупівлю може бути укладено лише з одним постачальником, за відсутності при цьому альтернативи. Відповідно до зведеного переліку природних монополій станом на 31.12.2021 року, що офіційно опублікований на сайті Антимонопольного комітету України 31.12.2021 року за посиланням (http://www.amc.gov.ua), ПАТ "Черкасиобленерго" внесено до зведеного переліку суб'єктів природних монополій по наданню послуг з розподілу електричної енергії на території Черкаської області (порядковий номер 72). Послуги з розподілу електричної енергії за місцезнаходженням Замовника можуть бути надані лише певним виконавцем , а саме ПАТ "Черкасиобленерго". Інша альтернатива відсутня. Тому, договір про закупівлю послуги з розподілу електроенергії, може бути укладений лише з одним виконавцем, а саме з ПАТ "Черкасиобленерго"
