Explanation

Уповноважена особа з конкурсних торгів відміняє процедуру закупівлі, так як замовник може на будь-якій зі стадій проведення торгів відмінити процедуру закупівлі на підставі ч. 17 п. 2 ст. 14 ЗУ “Про здійснення державних закупівель” у разі неможливості усунення порушень, які виникли через виявлені порушення законодавства з питань державних закупівель. Та зазначає, що з метою уникнення відповідальності в результаті виявлення порушень контролюючими органами, та в зв'язку з тим, що після розкриття поданих конкурсних пропозицій ми не можемо вносити зміни до ТД необхідно прийняти рішення про відміну процедури закупівлі на підставі цього пункту. Неможливості усунення порушень, що виникли через виявлені порушення законодавства у сфері публічних закупівль – замовник укладає договір про закупівлю з учасником, який визнаний переможцем спрощеної закупівлі, не пізніше ніж через 20 днів з дня прийняття рішення про намір укласти договір про закупівлю.
