Роботи виконуються Виконавцем, згідно завдання на проєктування та відповідних вихідних даних, які надаються Замовником протягом 5 (п’яти) календарних днів від дати підписання цього Договору.

Description:

Джерело фінансування – кошти місцевого бюджету(бюджет м.Києва) Умови оплати – відстрочка платежу. Оплата виконаних робіт здійснюється Замовником за умови наявності на рахунку Замовника коштів на фінансування робіт. Розрахунки по цьому договору проводяться по факту виконаних проєктних робіт після підписання Сторонами Акту приймання-передачі виконаних Робіт відповідно до умов цього Договору, який підписується за умови отримання Замовником проєктної документації і позитивного експертного звіту (висновку) до неї, протягом 5 (п’яти) банківських днів з дати отримання бюджетного призначення на фінансування закупівлі на свій реєстраційний рахунок відповідно до вимог п.2 ст.49 Бюджетного Кодексу України. Розрахунки за виконані Роботи проводяться відповідно до вимог Бюджетного кодексу України. Бюджетні зобов’язання за договором виникають лише у разі наявного бюджетного фінансування в межах фактичних надходжень до спеціального фонду бюджету міста (ст. 23, 48 Бюджетного Кодексу України) та доведених головним розпорядником асигнувань. В разі затримки фінансування, оплата виконаних Робіт здійснюється Замовником протягом 5 (п’яти) робочих днів, з моменту отримання на свій рахунок коштів фінансування Робіт. У разі затримки фінансування та/або здійснення платежів не з вини Замовника штрафні санкції до Замовника не застосовуються. У разі виникнення обставин, що перешкоджають своєчасній оплаті Робіт, Замовник письмово повідомляє про це Виконавця. В разі виявлення контролюючими органами завищення обсягів і вартості виконаних Робіт, Виконавець зобов’язаний повернути Замовнику кошти у сумі таких завищень.
