Послуги з дезинфекції, дезинсекції та дератизації

Мова (мови), якою (якими) повинні готуватися тендерні пропозиції: Тендерна пропозиція та усі документи, які передбачені вимогами тендерної документації та додатками до неї складаються українською мовою. Документи або копії документів (які передбачені … вимогами тендерної документації та додатками до неї), які надаються Учасником у складі тендерної пропозиції, викладені іншими мовами, повинні надаватися разом із їх автентичним перекладом на українську мову. Переклад має бути підписаний або завірений особою, уповноваженою на підписання тендерної пропозиції та може бути засвідчений печаткою Учасника, в разі її використання. Допускається без перекладу бланк підприємства /установи/організації та штампи в кресленнях або тому подібне.

Disinfection, disinsection and deratization services

The language (languages) of the bids: The tender proposal and all documents stipulated by the requirements of the tender documentation and its appendices shall be drawn up in the Ukrainian language. Documents or their copies (provided by the requirements of the bidding documents and annexes hereto), submitted by the Bidder as a part of the competitive bid, set forth in the other languages, must be submitted together with their authentic translation into the Ukrainian language. Translation must be signed or certified by the person, authorized to sign the competitive bid and may be certified by the stamp of the Bidder, if used. Enterprise/institution/organization letterheads and stamps in the drawings etc. are allowed without translation.

Explanation

Відповідно до Закону України «Про публічні закупівлі» закупівля здійснюється на підставі затвердженого плану закупівель. Тендерною документацією на закупівлю № UA-2020-11-03-010564-c передбачено строк надання послуг «Протягом 2020 року, згідно письмової рознарядки (заявки) Замовника», відповідно в проєкті договору про закупівлю встановлено строк дії договору до 31.12.2020, що є істотними умовами договору. Згідно ч. 12 ст. 28 Закону якщо оголошення про проведення конкурентної процедури закупівлі оприлюднюється відповідно до частини третьої статті 10 цього Закону, замовник розглядає тендерні пропозиції на відповідність вимогам тендерної документації до проведення оцінки тендерних пропозицій у строк, що не перевищує 20 робочих днів. Після оприлюднення замовником протоколу розгляду тендерних пропозицій електронною системою закупівель автоматично розсилаються повідомлення всім учасникам тендеру та оприлюднюється перелік учасників, тендерні пропозиції яких не відхилені згідно з цим Законом. Дата і час проведення електронного аукціону визначаються електронною системою автоматично, але не раніше ніж через п’ять днів після оприлюднення протоколу розгляду тендерних пропозицій. Так, за результатами розгляду тендерних пропозицій 22.12.2020 відбувся електронний аукціон. Частиною 5 статті 33 Закону України «Про публічні закупівлі» встановлено, що з метою забезпечення права на оскарження рішень замовника договір про закупівлю не може бути укладено раніше ніж через 10 днів з дати оприлюднення в електронній системі закупівель повідомлення про намір укласти договір про закупівлю. Враховуючи те, що згідно тендерної документації та проєкту договору, строк його дії до 31.12.2020, станом на 01.01.2021 можливість укладання договору за результатами проведеної закупівлі відсутня. Відповідно до вищезазначеного, наявна необхідність відмінити тендер на підставі пункту 2 частини 1 статті 32 Закону України «Про публічні закупівлі» (неможливості усунення порушень, що виникли через виявлені порушення законодавства у сфері публічних закупівель, з описом таких порушень, які неможливо усунути).

Замовник після підписання Сторонами Акта наданих послуг, протягом 45 (сорока п’яти) банківських днів з дати реєстрації податкової накладної, перераховує на поточний рахунок Виконавця 100% вартості фактично наданих Послуг на підставі наданого Виконавцем рахунку-фактури (термін оплати рахується з дати реєстрації податкової накладної для платників ПДВ; для неплатників ПДВ термін оплати рахується з дати підписання Сторонами Акта наданих послуг). After signing the act of services rendered by the Parties, within 45 (forty-five) banking days from the date of registration of the tax invoice, the Customer transfers to the current account of the Contractor 100% of the cost of services actually provided on the basis of the invoice provided by the Contractor (payment term is calculated from the date of registration of the tax invoice for VAT payers; for non-VAT payers the payment term is calculated from the date of signing the Act of services provided by the Parties).
