Учасники процедури закупівлі в період оскарження звернулися до Замовника з вимогами щодо відхилення тендерних пропозицій учасників процедури закупівлі та в подальшому не допущення їх до аукціону. У Замовника були відсутні технічні можливості для надання відповіді всім учасникам процедури закупівлі, які звернулися з вимогами до Замовника. Отже, на підставі п. 2 ч. 1 ст. 32 Закону України «Про публічні закупівлі» – замовник відміняє тендер у разі неможливості усунення порушень, що виникли через виявлені порушення законодавства у сфері публічних закупівель, з описом таких порушень, які неможливо усунути.
