згідно роз’яснень, наданих Міністерством розвитку економіки, торгівлі та сільського господарства: «Порядок придбання товарів, робіт і послуг, здійснення закупівель замовником у разі: 1) виникнення додаткової потреби у товарах, роботах чи послугах, яку … замовник не міг передбачити; 2) виділення додаткових коштів; 3) перерозподілу коштів, зекономлених внаслідок проведення процедур закупівель; 4) коштів зекономлених у разі зміни ціни договору в бік зменшення; 5) розірвання договору про закупівлю та необхідності здійснення нової закупівлі; 6) інших подібних випадках, такий предмет закупівлі у вищевказаних випадках вважатиметься новим предметом договору
