impossibility of eliminating the revealed violations of legislation in the field of public procurement

Explanation

Уповноваженою особою було запропоновано відмінити процедуру спрощеної закупівлі. Рішення аргументовано тим, що в зв’язку з неможливістю усунення порушень, що виникли через виявлені порушення законодавства у сфері публічних закупівель, які неможливо усунути, а саме відкоригувати параметри спрощеної закупівлі та привести технічні та якісні характеристики предмета закупівлі до відповідності. Враховуючи вищевикладене, пропонується відмінити закупівлю відповідно до ст. 14, частини 17, п. 2. Закону України «Про публічні закупівлі» неможливість усунення порушень, що виникли через виявлені порушення законодавства з питань публічних закупівель.
