Description:

Відповідно до чинного законодавства, при наявності бюджетних призначень Замовник надає Підряднику попередню оплату у розмірі до 100% вартості річного обсягу робіт на строк до 12 місяців, але не більше строку дії договору, шляхом спрямування бюджетних коштів Підряднику на небюджетні рахунки, відкриті на його ім’я в органах Державної казначейської служби у встановленому законодавством порядку протягом 10 робочих днів з дня отримання рахунку, з подальшим використанням зазначених коштів Підрядником з таких рахунків на цілі передбачені для виконання даного договору (на оплату матеріалів, конструкцій, виробів, обладнання та устаткування, оплату договорів субпідряду (в тому числі надання попередньої оплати субпідрядникам), виплату заробітної плати, оплату робіт і послуг, які необхідні для виконання даного договору, сплату податків, зборів та здійснення інших оплат необхідних для виконання договору підряду). Датою надання попередньої оплати вважається дата зарахування коштів на небюджетний рахунок Підрядника, відкритий на його ім’я в органах Державної казначейської служби. Ненадання попередньої оплати не впливає на строк виконання робіт за Договором. Підрядник зобов’язується використати отриману попередню оплату в визначений строк, що буде підтверджено документами, визначеними в п. 4.3 цього Договору. По закінченню терміну використання попередньої оплати, невикористані суми попередньої оплати повертаються Замовнику у той же день. Після отримання попередньої оплати у сумі менше ніж 100% вартості річного обсягу робіт Підрядник має право надавати до оплати документи, визначені у п. 4.3. Договору та отримувати проміжні платежі не зараховуючи суми, вказані у таких документах в погашення отриманої попередньої оплати. Залік попередньої оплати здійснюється на підставі актів приймання виконаних будівельних робіт - форма КБ-2в, довідок про вартість виконаних будівельних робіт та витрат –форма № КБ-3.
