За закупівлею: код ДК 021:2015: 42130000-9 Арматура трубопровідна: крани, вентилі, клапани та подібні пристрої (Запірна арматура сталева) (номер тендеру в ЦБД UA-2020-07-01-001313-b) було оголошено процедуру відкритих торгів. Оголошення про проведення процедури закупівлі додатково оприлюднено в електронній системі закупівель англійською мовою. Згідно пункту 1 статті 31 «Розкриття тендерних пропозицій/пропозицій» Закону України «Про публічні закупівлі» від 25.12.2015 року №922-VIII (надалі - Закон): У разі якщо оголошення про проведення конкурентної процедури закупівлі оприлюднюється відповідно до частини третьої статті 10 цього Закону, у день і час закінчення строку подання тендерних пропозицій, зазначених в оголошенні, електронною системою закупівель автоматично розкриваються всі файли тендерної пропозиції, крім інформації про ціну/приведену ціну тендерної пропозиції. В складі пропозиції Товариства з обмеженою відповідальністю "ПРОМСПЕЦТЕХ" міститься інформації про ціну (комерційна пропозиція), що суперечить вимогам Закону. Згідно пункту 2 частини 1 статті 32 «Відміна тендеру чи визнання тендеру таким, що не відбувся» Закону: Замовник відміняє торги в разі неможливості усунення порушень, що виникли через виявлені порушення законодавства у сфері публічних закупівель, з описом таких порушень, які неможливо усунути.
