При розгляді тендерним комітетом ДП «Медзакупівлі України» тендерної пропозиції товариства з обмеженою відповідальністю "МЕДІКОР,ЛТД" встановлено наступне. Відповідно до частини першої статті 17 Закону Замовник приймає рішення про відмову учаснику в участі у процедурі закупівлі та зобов’язаний відхилити тендерну пропозицію учасника або відмовити в участі у переговорній процедурі закупівлі (крім випадків, зазначених у пунктах 2, 4, 5 частини другої статті 40 цього Закону) в разі, зокрема, якщо суб’єкт господарювання (учасник) протягом останніх трьох років притягувався до відповідальності за порушення, передбачене пунктом 4 частини другої статті 6, пунктом 1 статті 50 Закону України "Про захист економічної конкуренції", у вигляді вчинення антиконкурентних узгоджених дій, що стосуються спотворення результатів тендерів. Відповідно до Зведених відомостей щодо спотворення результатів торгів, що розміщені на веб-сайті Антимонопольного комітету України наявні підстави для відмови товариству з обмеженою відповідальністю "МЕДІКОР,ЛТД" в участі у процедурі закупівлі та відхилення його тендерної пропозиції на підставі рішення Рішення Адмінколегії Київського Територіального відділення Антимонопольного комітету України від 12.03.2020 № 60/14-р/к. Враховуючи викладене, відповідно до частини першої статті 31 Закону, Замовник відхиляє тендерну пропозицію із зазначенням аргументації в електронній системі закупівель у разі, зокрема, якщо відповідно до пункту 1 частини першої статті 31 Закону - учасник процедури закупівлі не відповідає кваліфікаційним (кваліфікаційному) критеріям, установленим статтею 16 цього Закону та/або наявні підстави, встановлені частиною першою статті 17 цього Закону.
