Explanation

Технічною документацією закупівлі передбачене надання авторизаційного листа виключно від виробника. Це унеможливлює підтвердження як переможців пропозицій від учасників з авторизацією від офіційних дистрибюторів. Хоча безсумнівно, даний тип авторизації є достатньою гарантією якості товару та законності його ввезення в країну. Неможливість оголошення переможцями учасників з пропозиціями які пропонують якісний товар за кращою ціною, але містять авторизацію від офіційних дилерів – суперечить принципам публічним закупівель, а саме принципу «максимальна економія, ефективність та пропорційність публічних закупівель» закріпленого в нормах ч. 2 ст. 5 ЗУ «Про публічні закупівлі» Відповідно до ч. 2 ст. 17 ЗУ «Про публічні закупівлі»: замовник відміняє спрощену закупівлю в разі неможливості усунення порушень, що виникли через виявлені порушення законодавства з питань публічних закупівель. Враховуючи вищезазначені обставини Замовник вважає за правильне скасувати дану закупівлю, оскільки на даному етапі закупівлі неможливо зміна вимог технічної документації щодо авторизації учасників.
