На підставі підпункту 1 пункту 2 частини 1 статті 31 Закону України «Про публічні закупівлі», а саме учасник не відповідає умовам технічної специфікації та іншим вимогам щодо предмета закупівлі тендерної документації. Умови проживання Учасника ТОВ "Прибрежний" не відповідають технічним вимогам до закупівлі. Згідно з технічними вимогами Замовника передбачається направити на оздоровлення 1000 дітей з умовами проживання в кімнатах до 4 осіб з умивальниками, душовими кабінами та туалетів в кожній кімнаті або в блоці. В Акті приймання передачі табору «Прибрежний» за 2020 рік (далі – Акт), який учасник надав у складі своєї тендерної пропозиції, зазначено що у власних 5 спальних корпусах табору «Прибрежний» вбиральні розміщені на поверсі, що не відповідає технічним вимогам до закупівлі про наявність умивальників, душових кабін, туалетів у кожній кімнаті або блоці. Також, у цьому Акті, в 2 спальних корпусах 2020 року будівництва вбиральні розміщені у кімнатах. Згідно з Актом приймання-передачі до договору оренди нерухомого майна від 03.02.2020: в наявності два двоповерхових спальних корпуси загальною площею 1 654,9 м. кв., корпус № 1 – 18 кімнат, корпус № 2 – 22 кімнати, ці корпуси вміщують загалом 240 місць (разом 40 кімнат загальною місткістю усього 240 місць, що складає по 6 осіб у кімнаті), що не відповідає технічним вимогам до закупівлі, а саме немає можливості надати оздоровлення у відповідних умовах для 1000 дітей. При цьому в технічних характеристиках (Порівняльна таблиця згідно додатку 5 до тендерної документації) ТОВ Прибрежний зазначає, що умивальники, душові кабіни та туалети знаходяться в кожній кімнаті та відповідають вимогам Замовника.

На підставі підпункту 2 пункту 1 та підпункту 1 пункту 2 частини 1 статті 31 Закону України «Про публічні закупівлі», а саме учасник не відповідає встановленим абзацом першим частини третьої статті 22 Закону України «Про публічні закупівлі» вимогам до учасника відповідно до законодавства та не відповідає умовам технічної специфікації та іншим вимогам щодо предмета закупівлі тендерної документації. Учасник ТОВ "Примор'я" у складі тендерної пропозиції на вимогу тендерної пропозиції не надав свідоцтво про державну реєстрацію або виписку або витяг з Єдиного державного реєстру юридичних осіб, фізичних осіб-підприємців та громадських формувань. Відсутній акт приймання-передачі табору згідно договору оренди будівель санаторію імені С. Лазо від 28 лютого 2020 року № 28/02-2020. Відсутня інформація про правила перебування дитини у закладі для ознайомлення батьків та дітей в довідці про дитячий заклад оздоровлення та відпочинку згідно додатку 9 тендерної документації. Відповідно до акту приймання дитячого оздоровчого табору від 29 травня 2019 рік дитячого санаторного табору ім. С. Лазо, ТОВ "Примор'я", що наданий учасником у складі тендерної пропозиції, розрахункова місткість дитячого оздоровчого табору складає 330 місць за зміну, що не відповідає технічним вимогам до закупівлі, а саме згідно технічних вимог до закупівлі передбачається направити на відпочинок 1000 дітей.
