Згідно з пунктом 5 Прикінцевих та перехідних положень нової редакції Закону України «Про публічні закупівлі», що вводиться в дію 19.04.2020 IX (далі - новий Закон), процедури закупівель товарів, робіт і послуг, розпочаті до введення в дію цього Закону, завершуються відповідно до порядку, що діяв до введення в дію цього Закону. Допорогова закупівля не є процедурою закупівлі в розумінні Закону про публічні закупівлі. Вважаємо, що у разі продовження вказаної допорогової закупівлі буде недотримано норм ч. 10 ст. 3 Закону України «Про публічні закупівлі» в новій редакції, що набрала законної сили 19.04.2020 року.
