1. Рішення Колегії від 30.06.2020 № 12780-р/пк-пз, яким Колегія постановила зобов’язати акціонерне товариство «Українська залізниця» в особі філії «Центр забезпечення виробництва» скасувати рішення про відхилення тендерної пропозиції товариства з обмеженою відповідальністю «ВИРОБНИЧО-КОМЕРЦІЙНА ФІРМА «ДНІПРО-ПІВДЕНЬ» та рішення про визначення товариства з обмеженою відповідальністю «ПРОМИСЛОВО ВИРОБНИЧА КОМПАНІЯ АЛЬТАІР» переможцем Процедури закупівлі. 2. Тендерну документацію, відповідно до пункту 3.5 якої тендерні пропозиції учасників вважаються дійсними протягом 120 днів з дати розкриття. Розкриття тендерних пропозицій відбулося 27.04.2020 року. Отже, тендерні пропозиції учасників були дійсними до 27.08.2020 року. 3. Закон України «Про публічні закупівлі» (в редакції, що діяла до 19.04.2020 року) (далі — Закон), зокрема, частину другу статті 32 Закону, яка говорить, що Замовник укладає договір про закупівлю з учасником, який визнаний переможцем торгів протягом строку дії його пропозиції, не пізніше ніж через 20 днів з дня прийняття рішення про намір укласти договір про закупівлю відповідно до вимог тендерної документації та пропозиції учасника-переможця. 4. Встановили, що у Замовника відсутні підстави продовжувати процедуру закупівлі, адже укласти договір з переможцем відповідно до зазначених норм Закону буде неможливо.
