The reason for cancellation of the procurement

Explanation

Замовник не має права продовжувати допорогову закупівлю за порядком, що діяв до введення в дію нового Закону. Якщо Замовник не завершив до 19 квітня 2020 р. допорогові закупівлі, то він вже має проводити після 19 квітня закупівлю за новим Законом. Якщо річна вартість предмета закупівлі складає більше 50 тис. грн., то Замовник згідно з новою редакцією Закону має провести спрощену закупівлю і у нього немає можливості провести допорогову закупівлю. Якщо замовник укладе договір після 19 квітня по незавершеній до 19 квітня допороговій закупівлі без проведення спрощеної закупівлі, то це можна вважати недотриманням норм ч. 10 ст. 3 нового Закону. Тому Замовник вимушений відмінити допорогову закупівлю, яка не завершилась договором до 19 квітня 2020 року та оголосити спрощену закупівлю.
