Description:

Оплата за Товар здійснюється шляхом перерахування Замовником грошових коштів на поточний рахунок Постачальника протягом 15 (п’ятнадцяти) банківських днів з дня отримання Замовником оригіналу належним чином оформленого рахунку, за умови наявності підписаної Сторонами видаткової накладної. До видаткової накладної Постачальник додає документи, визначені пунктами 2.2 та 2.3 Договору (в паперовому та/або електронному вигляді), та ключи активації. Оплата, порядок здійснення якої визначено у п. 4.1, 4.4 Договору, Замовник здійснює за умови (відкладальна обставина згідно з ч. 1 ст. 212 Цивільного кодексу України) затвердження фінансового плану Замовника на відповідний рік (Постанова Кабінету Міністрів України від 03.10.2012 № 899) та наявності в ньому витрат на закупівлю Товару, що є предметом Договору. Розрахунки за Договором здійснюються в національній валюті України в безготівковій формі, шляхом перерахування грошових коштів на поточний рахунок Постачальника у відповідній установі банку. Обов’язок Замовника по оплаті вважається виконаним в момент зарахування грошових коштів на поточний рахунок Постачальника. Джерело фінансування закупівлі – власні кошти підприємства.

Тендерна пропозиція учасника ТОВ «СПАН» – не відповідає вимогам тендерної документації. Згідно з п. 1 розділу III. Інструкція з підготовки тендерної пропозиції Тендерною документацією встановлено, що учасник у складі своєї тендерної пропозиції повинен надати заповнену довідку, яка містить відомості про учасника (згідно з додатком 5 до ТД). В порушення вимог тендерної документації, учасником ТОВ «СПАН», в складі тендерної пропозиції не надано заповнену довідку, яка містить відомості про учасника (згідно з додатком 5 до ТД), отже учасником не виконано вимоги ТД в частині п.1. розділу ІІІ Інструкція з підготовки тендерної пропозиції. Відхилити тендерну пропозицію учасника ТОВ «СПАН» на підставі п.4 частини першої ст.30 Закону України «Про публічні закупівлі», а саме: тендерна пропозиція не відповідає умовам тендерної документації.
