Після розгляду документів було встановлено наступне: Пунктом 3.1 тендерної документації передбачено, що тендерна пропозиція подається в електронному вигляді шляхом ... завантаження файлів серед яких інформацією про необхідні технічні, якісні та кількісні характеристики предмета закупівлі, а також відповідну технічну специфікацію (у разі потреби (плани, креслення, малюнки чи опис предмета закупівлі) – згідно Додатку 3 до цієї тендерної документації. Крім того, п. 3.6 тендерної документації передбачає, що учасники процедури закупівлі повинні надати в складі тендерної пропозиції Інформацію про відповідність запропонованого товару технічним, якісним, кількісним та іншим вимогам замовника до предмета закупівлі, оформлену за формою наведеною у Зразку 1 з урахуванням технічних вимог замовника, зазначених у Додатку №3. У складі тендерної пропозиції ТОВ «СПЕЦТРЕЙДИНГ» завантажений файл «тех докум.pdf» в якому міститься «Інформація про необхідні технічні, якісні та кількісні характеристики предмета закупівлі». У позиції 17 даного файлу міститься креслення, однак на ньому відсутній один із показників розміру запропонованого Учасником товару, а саме значення «197» як вимагалося замовником відповідно до Додатку 3 тендерної документації. Таким чином тендерна пропозиція учасника не відповідає умовам тендерної документації.

Після розгляду документів було встановлено наступне: Пунктом 3.2 тендерної документації передбачено, що учасник у складі тендерної пропозиції надає забезпечення тендерної пропозиції (документ, що підтверджує надання учасником забезпечення тендерної пропозиції). Вид забезпечення тендерної пропозиції: електронну банківську гарантію подають у вигляді електронного документа з накладанням кваліфікованого електронного підпису (електронного цифрового підпису) гаранта на суму: 210 000,00 грн. (двісті десять тисяч гривень, 00 коп.) У складі тендерної пропозиції ТОВ «МЕТПРОЕКТ» відсутній документ, що підтверджує надання Учасником забезпечення тендерної пропозиції. Таким чином тендерна пропозиція Учасника не відповідає умовам тендерної документації.
