Description:

11.5. Замовник при наявності бюджетних коштів перераховує Генпідряднику аванс на придбання матеріалів, конструкцій, виробів у розмірі не більше 30% від вартості річного обсягу робіт за цим Договором згідно постанови Кабінету Міністрів України від 27.12.2001р. №1764 «Про затвердження Порядку державного фінансування капітального будівництва» (зі змінами) та постанови Кабінету Міністрів України №117 від 23.04.2014 р. «Про здійснення попередньої оплати товарів, робіт і послуг, що закуповуються за бюджетні кошти» (зі змінами).Генпідрядник зобов'язується використати одержаний аванс на придбання і постачання необхідних для виконання робіт матеріалів, конструкцій, виробів протягом трьох місяців після одержання авансу. По закінченні тримісячного терміну невикористані суми авансу повертаються Замовнику. 11.6. Використаний аванс погашається на підставі актів виконаних робіт по формі №КБ-2в, підписаного уповноваженими представниками Сторін. 11.7. Замовник має право контролювати використання наданих Генпідряднику сум авансу.

Description:

11.1. Розрахунки за виконані роботи здійснюються на підставі акту здачі-приймання виконаних робіт по формі №КБ-2в, довідки про вартість виконаних будівельних робіт по формі №КБ-3 та рахунку на оплату робіт. Проміжні платежі за виконані роботи здійснюються в межах не більш як 95 відсотків їх загальної вартості за договірною ціною. Кінцеві розрахунки здійснюються у двотижневий термін після виконання і приймання всіх передбачених Договором робіт та реєстрації декларації про готовність об'єкта до експлуатації. 11.2. Генпідрядник визначає обсяги та вартість виконаних робіт, що підлягають оплаті, та готує відповідні документи і подає їх для підписання Замовнику. Замовник протягом 5 робочих днів зобов'язаний підписати подані Генпідрядником документи, що підтверджують виконання робіт, або письмово обґрунтувати причини відмови від їх підписання. 11.3. Вартість виконаних робіт, що підлягають оплаті, визначаються із урахуванням обсягів виконаних робіт та фактичних витрат Генпідрядника, підтверджених відповідними документами. 11.4. Розрахунки за виконані роботи з субпідрядниками здійснюються Генпідрядником. 11.8. Генпідрядник зобов'язаний надати Замовнику копії накладних на придбані матеріали та сертифікатів (паспортів) підтвердження якості матеріалів. 11.9. Бюджетні зобов’язання беруться Замовником в межах бюджетних асигнувань. Бюджетні фінансові зобов’язання за спеціальним фондом бюджету беруться Замовником виключно в межах відповідних фактичних надходжень спеціального фонду бюджету.
