Згідно частини 2, ст. 31 Закону України «Про публічні закупівлі» №922-VIII від 25.12.2015 р. (зі змінами та доповненнями, далі – Закон), Замовник має право визнати торги такими, що не відбулися, у разі якщо здійснення закупівлі стало неможливим унаслідок непереборної сили. У зв’язку із виникненням особливих соціальних обставин, що ставлять в небезпеку життя та здоров’я громадян, внаслідок втрати можливості з незалежних від Замовника обставин бути забезпеченим газом для опалення та обігріву приміщень в розпал опалювального сезону та можливості здійснення робочого процесу, необхідно визнати відкриті торги за предметом закупівлі природного газу (09120000-6 — Газове паливо) такими, що не відбулися
