Замовник дотримується порядку здійснення публічних закупівель, встановленого Законом України «Про публічні закупівлі», та закуповує товар (електрична енергія) за процедурою «Звіт про укладений договір» у зв’язку з тим, що вартість предмета закупівлі … перевищує 50 тис. грн. та одночасно є меншою за 200 тис. грн. Закупівля здійснюється в природного монополіста, з врахуванням відсутності конкуренції (у тому числі з технічних причин) на відповідному ринку, внаслідок чого договір про закупівлю може бути укладено лише з одним постачальником, за відсутності при цьому альтернативи.
