Тендерному комітету КУ "ООКЛ" необхідно було прийняти рішення про відміну вищезазначеної Процедури , оскільки Постійно діюча адміністративна колегія Антимонопольного комітету України з розгляду скарг про порушення законодавства у сфері публічних закупівель постановила зобов’язання для КУ «ООКЛ» , керуючись частиною третьою статті 8 та статтею 18 Закону України « Про здійснення державних закупівель». Також, згідно п. 11 ст. 18 Закону України «Про публічні закупівлі» рішення АМК розміщується в електронній системі закупівель та автоматично оприлюднюється на веб - порталі Уповноваженого органу протягом трьох робочих днів з дня його прийняття . Рішення було прийнято - 02.03.2017 року, а оприлюднено 11.03.2017 року, що порушує строки оприлюднення цього Закону.
