Відповідно до ч. 4 ст. 28 ЗУ «Про публічні закупівлі» строк розгляду тендерної пропозиції не повинен перевищувати п’яти робочих днів з дня визначення переможця. Навіть , якщо визначити переможця на другий робочий день після аукціону, а саме 21.12.2016 року, то підписання договору, згідно ст. 32 Закону, можливе лише 01.01.2017 року. Оскільки здійснення закупівлі лікарських препаратів передбачалась до 31 грудня 2016 року на кошти бюджету 2016 року, договір не може бути укладений у 2017 році. Виходячи з вищенаведеного, немає можливості завершити розпочату процедуру закупівлі, внаслідок чого, необхідно її відмінити.
