Враховуючи строки розгляду скарги, що встановлені у ч.6 ст. 18 Закону, а саме 15 робочих днів з дати початку розгляду скарги, Замовник ніяким чином не може розраховувати на укладання договору у 2016 році, отриманні товару у 2016 році та здійснення його оплати, виходячи з того, що фінансування вказаної закупівлі здійснюється за рахунок коштів 2016 року. Враховуючи вищенаведене, Замовник змушений визнати торги такими, що не відбулися, у разі якщо здійснення закупівлі стало неможливим унаслідок непереборної сили відповідно до ч. 2 ст. 31 Закону.
