«7» листопада 2016 р. тендерним комітетом Відділу освіти Пустомитівської районної державної адміністрації було розпочато процедуру відкритих торгів для закупівлі газу природного(ідентифікатор закупівлі: UA-2016-11-07-000651-c) на 2017 рік, «19» січня 2017 року відбувся аукціон, за результатами якого надійшло дві тендерні пропозиції від Учасників. Відповідно до ч. 4 ст.28 ЗУ «Про публічні закупівлі» після оцінки пропозицій Замовник розглядає тендерні пропозиції на відповідність вимогам тендерної документації з переліку учасників, починаючи з учасника, пропозиція якого за результатом оцінки визначена найбільш економічно вигідною. Строк розгляду тендерної пропозиції, яка за результатами оцінки визначена найбільш економічно вигідною, не повинен перевищувати п’яти робочих днів з дня визначення найбільш економічно вигідної пропозиції. Тендерним комітетом було пропущено строк розгляду тендерної пропозиції. У зв’язку з цим, керуючись п. 3 ч.1 ст.32 ЗУ «Про публічні закупівлі», а саме: порушення порядку оприлюднення повідомлення про намір укласти договір, виникає нагальна необхідність відмінити процедуру закупівлі з метою усунення порушення законодавства у сфері держзакупівель.
