Якщо переможцем став інший учасник аукціону, договір з чинним орендарем припиняється у зв'язку з закінченням строку, на який його укладено. При цьому якщо строк дії договору з чинним орендарем закінчився, такий договір вважається продовженим до моменту укладання договору з переможцем аукціону. Суборенда не допускається. У разі, якщо переможцем електронного аукціону визначено учасника, який не здійснював витрати на проведення незалежної оцінки об'єкта оренди, такий переможець зобов'язаний до укладання догвору оренди відшкодувати особі, яка здійснила відповідні витрати, вартість проведеної незалежної оцінки майна.
