Аналогічна позиція викладена у Рішенні №11750-р/пк-пз від 31.07.2023 Комісії Антимонопольного комітету України з розгляду скарг про порушення законодавства у сфері публічних закупівель, в якому зазначено наступне: «Скаржник не довів, що запропонований Переможцем товар за показниками "Кількість акумуляторів у батареї", "Номінальна ємність батареї" та "Номінальна напруга" має гірші характеристики.
Разом з тим, запропонований Переможцем товар не відповідає вимогам, наведеним в Документації за показником "Максимальні габаритні розміри однієї секції"
