Скаржник вважає, що Замовник не мав підстав вважати, що тендерна пропозиція Скаржника не відповідає умовам технічної специфікації та іншим вимогам щодо предмета закупівлі, спираючись при цьому лише на певні дані з сайту виробника. Внаслідок чого замовник не мав права відхиляти тендерну пропозицію Скаржника і переходити до розгляду наступної пропозиції.
