При детальному аналізі та вивченні тендерної пропозиції учасника ФОП Гук Г.В. встановлено порушення законодавства у сфері публічних закупівель, а саме:
- Умовами тендерної документації передбачено пасажиромісткість транспортних засобів запропонованих до участі у процедурі закупівлі. У тендерній пропозиції учасника ФОП Гук Г.В. міститься довідка щодо наявності в учасника обладнання та матеріально-технічної бази від 10.01.20р. №6, в якій кількість місць транспортних засобів не відповідає пасажиромісткості транспортних засобів згідно умов тендерної документації;
- У тендерній пропозиції учасника за лотами 10, 11, 41, 57 відсутній підписаний учасником Проект договору про закупівлю (згідно Додатку 7 тендерної документації);
Таким чином, за тендерна пропозиція учасника ФОП Гук Г.В. підлягає відхиленню відповідно до пункту 4 частини 1 статті 30 Закону України «Про публічні закупівлі» № 922-VIII від 25.12.2015 року.
