Замовником здійснено встановлення умов закупівлі щодо предмета закупівлі, а саме щодо його технічних вимог, які характерні для продукції лише одного виробника. Такі умови призводять до обмеження конкуренції і відповідно дискримінації учасників, тобто порушення принципу здійснення закупівель – недискримінації учасників.
