1. На підставіЗакону України «Про публічні закупівлі» істотні умови договору про закупівлю можуть змінюватись у випадку зміни ціни за одиницю товару не більше ніж на 10 відсотків у разі коливання ціни такого товару на ринку, згідно п.12.3. Розділу 12 Договору та умов Додатку №2 до Договору «Комерційна пропозиція №0:Індивідуальна комерційна пропозиція» Сторони домовились змінити ціну за електричну енергію за 1 кВт*год не більше ніж на 10 відсотків у зв’язку з коливанням ціни такого товару на ринку, та без збільшення загальної вартості договору, що підтверджується Експертним висновком №ЧК-138 від 13.04.2020 року, виданим Чернігівською регіональною Торгово-промисловою палатою, у зв’язку з чим, ціна за 1 кВт*год становить – 1,9258557888 грн., у тому числі ПДВ 20%- 0,3209759648 грн.

Керуючись нормами Закону України "Про публічні закупівлі", пп.12.3 та 12.6 Договору, відповідно до яких вартість договору може бути змінена за взаємною згодою сторін, зокрема внаслідок зменшення обсягів закупівлі з урахуванням фактичного обсягу видатків замовника, Сторони погодились зменшити обсяг постачання електричної енергії та визначити його в обсязі 892853 кВт*год., внаслідок чого зменшити суму договору та визначити в розмірі 1898728,87 грн.
