Керуючись частиною п'ятою статті 36 Закону України "Про публічні закупівлі", необхідно підписати другу додаткову угоду - встановлюючи суму пролонгованого договору. І в цій угоді обов’язково передбачають обсяг та суму, що не перевищують 20 %, визначених у договорі, укладеному в попередньому році.
