Керуючись ст.23 Бюджетного кодексу України та абз.4 ч.4 ст.36 Закону України «Про публічні закупівлі», згідно якої істотні умови договору про закупівлю не можуть змінюватися після його підписання до виконання зобов’язань сторонами в повному обсязі, крім випадків продовження строку дії договору та виконання зобов’язань щодо передання товару, виконання робіт, надання послуг у разі виникнення документально підтверджених об’єктивних обставин, що спричинили таке продовження, у тому числі непереборної сили, затримки фінансування витрат замовника, за умови, що такі зміни не призведуть до збільшення суми, визначеної в договорі, а також керуючись Листом Міністерства економічного розвитку і торгівліУкраїни від 27.10.2016 № 3302-06/34307-06 «Щодо зміни істотних умов договору про закупівлю».
