Керуючись п.7 ч.5 ст. 41 ЗУ "Про публічні закупівлі"де зазначено, що умови договору можуть змінюватись у разі зміни встановленого згідно із законодавством регульованих цін (тарифів), п.13.6.7 Договору на закупівлю електричної енергії №2022033-КЦ від 11 січня 2022р , у зв'язку зі зміною регульованих цін (тарифів) на послуги з передачі електричної енергії згідно Постанови НКРЕКП від 01.12.2021р. №2454 та послуг з розподілу електричної енергії згідно Постанови НКРЕКП від 17.12.2021р. №2600, що є складовими ціни товару.

Збільшення ціни за одиницю товару до 10 відсотків пропорційно збільшенню ціни такого товару на ринку у разі коливання ціни такого товару на ринку за умови, що така зміна не призведе до збільшення суми, визначеної в договорі про закупівлю, - не частіше ніж один раз на 90 днів з моменту підписання договору про закупівлю. Обмеження щодо строків зміни ціни за одиницю товару не застосовується у випадках зміни умов договору про закупівлю бензину та дизельного пального, газу та електричної енергії
