З урахуванням пунктів 3.4.1, 3.6, 10.3, 15.7 Договору про закупівлю № 09/150-06/2022 від 24.06.2022 р. (далі - Договір), на підставі листа Постачальника пpo проведення попередньої оплати від 01.09.2022 р. № 151 та банківської гарантії № 28765 від 30.08.2022 року, Замовником проводиться попередня оплата в розмірі 100 (ста) відсотків від ціни продукції, вказаної у Специфікації (Додаток 1 до Договору), на підставі оригіналу рахунку-фактури. Закупівля здійснювалась відповідно до постанови Кабінету Міністрів України від 28 лютого 2022 р. № 169. Відповідно до абзацу першого підпункту 1 пункту 1 Постанови в умовах воєнного стану оборонні та публічні закупівлі товарів, робіт і послуг здійснюються без застосування процедур закупівель та спрощених закупівель, визначених Законами України “Про публічні закупівлі” та “Про оборонні закупівлі”. Підстава "покращення якості предмета закупівлі, за умови що таке покращення не призведе до збільшення суми, визначеної в договорі про закупівлю", обрана у зв'язку із відсутністю в електронній системі підстави, яка відповідала би предмету додаткової угоди.
