З метою організації Закупівлі, з урахуванням статті 11 Закону, відповідно до п.3 ч.1 ст.3 Закону, цей Закон застосовується до замовників, визначених ч.1 ст.2 цього Закону, які здійснюють спрощені закупівлі відповідно до цього Закону та/або укладають договори без використання електронної системи закупівель відповідно до ч.2,3 і 7 цієї статті. Відповідно до п. 28 ч. 1 ст. 1 Закону спрощена закупівля – придбання замовником товарів, робіт і послуг, вартість яких дорівнює або перевищує 50 тисяч гривень та є меншою за вартість, що встановлена у п. 1 і 2 ч.1 ст. 3 Закону (далі – Спрощена закупівля). Таким чином, враховуючи вартісні межі передбачені Законом для даної Закупівлі, оголошено проведення Спрощеної закупівлі Замовником, ідентифікатор закупівлі: UA-Р-2021-12-09-009055-с. Спрощена закупівля не відбулась через відсутність учасників. Повторно оголошено проведення Спрощеної закупівлі Замовником, ідентифікатор закупівлі: UA-Р-2021-12-21-001864-b. Закупівля не відбулась через відсутність учасників. Отже, Спрощена закупівля двічі не відбулась. Відповідно до п. 1 ч.7 ст.3 Закону, придбання замовником товарів, робіт і послуг, вартість яких дорівнює або перевищує 50 тисяч гривень та є меншою за вартість, що встановлена у п.1 та 2 ч.1 цієї статті, здійснюється без застосування порядку проведення спрощених закупівель, встановленого цим Законом, у разі, якщо було двічі відмінено спрощену закупівлю через відсутність учасників, у тому числі частково (за лотом). При цьому предмет закупівлі, його технічні та якісні характеристики, вимоги до учасника не повинні відрізнятися від тих, що були визначені замовником в оголошенні про спрощену закупівлю. Враховуючи вищезазначене, існують усі законодавчі підстави, визначені Законом, для здійснення Закупівлі без застосування порядку проведення спрощених закупівель шляхом укладання договору без використання Електронної системи.
