Пунктом 2 частини 5 статті 41 Закону України "Про публічні закупівлі" встановлено, що істотні умови договору про закупівлю не можуть змінюватись після його підписання до виконання зобов'язань сторонами в повному обсязі, крім випадків зміни ціни за одиницю товару не більше ніж на 10 відсотків у разі коливання ціни такого товару на ринку, за умови, що зазначена зміна не призведе до збільшення суми, визначеної в договорі. Таким чином ціна договору складає 474699,10 гон з ПДВ (ПДВ - 79116,52 грн.), загальний обсяг постачання електричної енергії - 237499 кВт*год.

У зв'язку із коливанням ціни електричної енергії, керуючись вимогами Цивільного кодексу України, Закону України "Про ринрк електричної енергії", керуючись п.2, ч.5 статті 41 Закону України "Про публічні закупівлі" сторони домовились з 01 лютого 2021 року внести зміни до п.5.1, 5.2. Договору та викласти їх в настіпній редакції:
5.1. "Ціна договору складає 474699,10 грн., з ПДВ";
5.2. "Ціна за одиницю товару - за 1 кВт*год електричної енергії складає:
з 01.01.2021 по 31.01.2021 (включно) - 1,99874147280 грн. з ПДВ;
з 01.02.2021 - 2,1631794168 грн. з ПДВ"
