1. Розділу 5. Пункт 5.2. викласти у наступній редакції: «Споживач розраховується з Постачальником за електричну енергію за цінами, що визначаються відповідно до положень ст.56 Закону України "Про ринок електричної енергії" Ціна за 1 кВт.год не включає вартість послуг з розподілу електричної енергії, які оплачуються Споживачем самостійно Оператору системи розподілу. «Ціна купівлі електричної енергії для споживача буде формуватися відповідно до наступної формули: Це/е = Цфакт + Тпередачі + Цпостач. Цфакт – середньозважена ціна, що сформувалась на ринку електроенерії України, що станом на дату підписання цієї Додаткової угоди становить – 2,41007 грн./кВт*г; Тпередачі – тариф на передачу електроенергії, встановлена НКРЕКП для оператора системи передачі (ДП «НЕК «Укренерго»), що станом на дату підписання цієї Додаткової угоди становить - 0,29393 грн./кВт*г; Цпостач – ціна постачальника за послуги з постачання електричної енергії, що дорівнює 0,02 грн./кВт*г без ПДВ. Ціна за одиницю товару - за 1 кВт*год електричної енергії розраховується відповідно до формули та становить 2,724 грн (Дві гривні 724 копійки) без ПДВ, 0,5448 грн (Нуль гривень 5448 копійок) ПДВ, разом з ПДВ 3,2688 грн (Три гривні 2688 копійок).» Постачальник є стороною, відповідальною за баланс своїх споживачів відповідно до положень «Правил ринку». Умови цього договору про закупівлю не повинні відрізнятися від змісту тендерної пропозиції (у тому числі ціни за одиницю) переможця процедури закупівлі. 2. Додаток №1 до Договору викласти в наступній редакції: «Обсяг закупівлі Споживачем активної електричної енергії на 2021 рік становить: 325 909 ,25 кВт-год.»

Відповідно до звіту ДП «Оператор ринку» «Порівняльний аналіз роботи ринку «на добу наперед» та внутрішньодобового ринку» (далі - Звіт) , що опублікований 13.10.2021 року за 10 днів жовтня 2021 року, спостерігається підвищення середньозваженої ціни на РДН (ОЕС) по відношенню до 3 декади вересня, в зв'язку з чим Замовник та Постачальник дійшли згоди підвищити ціну за одиницю товару на 9,68%

У зв’язку з необхідністю проведення процедури закупівлі на початку 2022 року, керуючись ч.6.ст.41 Закону України «Про публічні закупівлі», Сторони погодили продовжити дію Договору № 107/21 від 16.08.2021 р. на строк до 31.03.2022 року. Збільшити суму договору № 107/21 від 16.08.2021на 20%, а саме до рівня 1 278 398,59 грн з ПДВ.
